0Introduction
Welcome to EyesAI. These Terms & Conditions (“Terms”) govern your access to and use of EyesAI’s services, including profile creation, automated content publishing, reporting, and related features (collectively, the “Services”). By subscribing, you agree to these Terms.
1Services Provided
- EyesAI creates and maintains an AI-optimized profile for your business, creator account, or freelancer brand.
- Profiles include schema markup, structured data, FAQs, and are hosted on EyesAI’s platform.
- Depending on your plan, EyesAI also generates and distributes monthly blogs, videos, review highlights, backlinks, citations, and social posts.
- Profiles are typically published within 24 hours of signup, though this is not a guaranteed timeframe.
2Subscription & Billing
- Services are billed as a recurring monthly subscription.
- Current plans:
- Discover – $39/month
- Verified – $69/month
- Payment is collected securely through Stripe. By subscribing, you authorize recurring monthly charges until you cancel.
- Prices may change with 30 days’ notice.
3Cancellation & Refund Policy
- You may cancel your subscription at any time via your account dashboard or by contacting support.
- Upon cancellation:
- Your EyesAI profile and all hosted content will be removed within 7 days.
- This includes blogs, videos, review graphics, backlinks, citations, and social posts created and hosted by EyesAI.
- You retain rights to your original business information (name, logo, website), but EyesAI-owned or hosted assets will no longer be accessible.
- All payments are non-refundable. Subscriptions will continue until canceled. No prorated refunds are issued for partial months.
4Content Ownership & Rights
- You retain ownership of your original business data (logos, brand names, trademarks).
- EyesAI owns the generated content (blogs, videos, posts, backlinks, citations) and licenses it to you while you are an active subscriber.
- If your subscription ends, you lose the right to continue using EyesAI-hosted or distributed content.
- EyesAI may reuse anonymized, aggregated versions of generated content for training, marketing, or benchmarking purposes.
5Communication Consent (SMS & Email)
- By subscribing, you agree to receive email and SMS notifications related to:
- Profile creation and updates
- Monthly reports
- Payment/billing notices
- Service announcements
- SMS messages may be automated. Standard carrier rates may apply.
- You may opt out of promotional SMS/email, but transactional communications (billing, reports, service alerts) cannot be opted out.
6No Guarantee of Results
- EyesAI uses structured data, backlinks, citations, and network effects to improve visibility in AI platforms and search results.
- While designed for AI discovery, EyesAI cannot guarantee rankings, placement, visibility, or specific business outcomes.
7Acceptable Use
- You agree not to:
- Provide false or misleading business information.
- Attempt to manipulate reviews or AI platforms through spam, fake content, or fraudulent activity.
- Use EyesAI to promote unlawful, offensive, or harmful content.
- Service announcements
- EyesAI may suspend or terminate accounts violating this section without refund.
8Service Availability
- EyesAI strives for continuous availability of the Services but does not guarantee uninterrupted or error-free operation.
- Downtime may occur for maintenance, technical issues, or third-party failures.
- EyesAI is not liable for interruptions, delays, or data loss.
9Termination by EyesAI
- EyesAI reserves the right to suspend or terminate your account at any time, without refund, if:
- You violate these Terms,
- Your use poses risk to the platform or community, or
- Required payments are not made.
10Intellectual Property
- All EyesAI trademarks, logos, software, and platform features are the property of EyesAI.
- No rights are granted to you except as necessary to use the Services under these Terms.
11Indemnification
- You agree to indemnify and hold EyesAI harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of:
- Your business operations,
- Your content or information provided to EyesAI, or
- Your use of the Services.
12Limitation of Liability
- EyesAI is not responsible for lost profits, business interruptions, or damages arising from the use (or inability to use) the Services.
- EyesAI’s total liability shall not exceed the amount you paid in the prior 3 months.
13Modifications
- EyesAI may update these Terms from time to time.
- Continued use of the Services constitutes acceptance of updated Terms.
14Governing Law & Disputes
- These Terms are governed by the laws of [Insert State].
- Any disputes shall be resolved exclusively in the courts of [Insert County/State].
